The Australian Securities and Investments Commission fined David Walsh’s holding company after it missed the deadline for lodging its 2025 financial statements.
The story
The Australian Securities and Investments Commission (ASIC) has issued an infringement notice to Downward Spiral Enterprises, the parent company of Morilla Estate that operates the Museum of Old and New Art (MONA) in Hobart. The notice carries a fine of $198,000 for failing to lodge the company’s 2025 financial report on time.
Downward Spiral Enterprises was one of 22 large Australian companies that received similar notices in the latest ASIC enforcement round. ASIC said the action is part of its ongoing surveillance and enforcement work aimed at ensuring compliance with financial reporting obligations.
A closer look
David Walsh, the sole director of Downward Spiral Enterprises, oversees a diversified portfolio that includes the MONA gallery, the Moorilla Estate winery, the craft‑brew brand Moo Brew and DarkLab, which runs the annual Dark Mofo festival. In June, the company lodged eight years of accounts covering 2019‑2025, revealing more than $695 million in dividend income that supports its cultural and hospitality ventures.
The delayed filing prompted ASIC to levy the fine despite the later submission of the overdue report. The regulator indicated that it will continue to monitor large entities for timely compliance and that further penalties may be applied where breaches persist.
